August 6 2012 Cebu charter day holiday

The province of Cebu will celebrate its annual charter day anniversary this coming August 6, 2012. The day, which falls on a Monday, is a special nonworking in the entire Cebu, including the following highly-urbanized cities: Cebu City, Danao, Lapulapu, Mandaue, and Toledo.

Cebuanos commemorate their provincial foundation day August 6 of every year by virtue of Republic Act 7698, which became a law in August 2000. Read the full text of RA 7698 in this link.

The celebration however has a vague historical basis. In a report last year, Sun.Star Cebu noted that August 6 became the foundation day of Cebu because of a resolution approved by its Provincial Board in 1993.

According to the resolution, Spain’s King Philip II (to whom the Philippines was named after) appointed Miguel Lopez de Legaspi as governor of Cebu on August 6, 1569. This event, the resolution states, “mark the foundation, although loosely, of a province of Cebu.”

According to the Department of Labor of Employment,employees who will report for work on this day are entitled to get an additional of 30% to their regular hourly rate. Meanwhile, those who will choose to stay at home are not bound to get paid “unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment of wages on special days even if unworked.”
