#WalangPasok – October 28 2021 declared holiday in Davao Occidental

The people of Davao Occidental will be celebrating its 8th foundation anniversary this coming October 28, Thursday.

The day is a special non-working holiday in the province as stipulated in Republic Act 11135, which was enacted into law in 2018 during the term of President Rodrigo Duterte. The full text of RA 11135 can be accessed here.

Davao Occidental is the newest province in the Philippines – having been carved out from the municipalities in the erstwhile second district of Davao del Sur. In 2013, residents of the municipalities of Don Marcelino, Jose Abad Santos, Sta. Maria, Sarangani, and Malita approved a plebescite that paved the way for the creation of a new province. Malita was selected as the capital town and seat of the government of Davao Occidental.

According to the 2020 DOLE handbook on workers statutory monetary benefits, the “no work, no pay” principle applies during special non-working holidays. Meaning, workers who are not required or permitted to work on special non-working days are not entitled to any compensation unless there is a collective bargaining agreement or a company policy that provides for that.

The handbook likewise highlighted that employees who work during special non-working days are entitled to receive an additional pay of 30% for every hour that they render service.
